Social Media Competitions
1. Introduction and Application
1.1 This competition (each a “Competition”) is published by Stake, which operates the website <stake.com> (“Website”).
1.2 Stake publishes Competitions from time to time, each of which is subject to the Website Terms and Conditions (“Terms and Conditions”) and the Stake Community Terms of Use (“Stake Community Terms of Use”), as well as these universal competition rules (“Rules”).
1.3 If there is any conflict between the Terms and Conditions, these Rules, the Stake Community Terms of Use, and the specific promotional post, announcement, or page relating to a Competition (“Competition Post”), the following order of precedence applies to the extent of any inconsistency:
a. the Terms and Conditions;
b. the Competition Post (to the extent expressly stated);
c. these Rules; and
d. the Stake Community Terms of Use.
1.4 By participating in any Competition, you agree to be bound by these Rules as amended, supplemented, or overridden by the relevant Competition Post.
2. No Consideration
2.1 Unless expressly stated otherwise in the relevant Competition Post, no purchase, payment, or wagering is required to enter or win a Competition.
3. Prizes
3.1 If you win a Competition, the nature, quantity, value, and type of prize (“Prize”) will be determined by Stake at its absolute discretion and described in the relevant Competition Post.
3.2 Prizes may include monetary prizes (including credits or cryptocurrency credited to your Stake account) and/or non-monetary prizes (including merchandise, physical goods, or experiences).
3.3 Prizes are not redeemable for cash, credit, or any alternative consideration unless expressly determined by Stake at its absolute discretion.
3.4 The value of any cryptocurrency Prize is determined at the time of transfer. Stake is not responsible for any subsequent fluctuations in value.
3.5 Prizes are non-transferable and may only be awarded to the verified winner.
4. Prize Pool Caps, Winner Limits, and Allocation
4.1 Where specified in a Competition Post, Stake may impose:
a. a total prize pool cap;
b. per-winner prize limits; and
c. a maximum number of winners.
4.2 Stake may allocate Prizes equally, proportionally, or otherwise among winners, including where a prize pool is shared.
4.3 All prize caps, limits, and allocation methods are final and binding and applied at Stake’s absolute discretion.
5. Substitution of Prizes
5.1 If a Prize (or any component of a Prize) becomes unavailable for any reason, Stake reserves the right, at its absolute discretion, to substitute the Prize with an alternative prize of equal or greater value or a different prize type.
5.2 Stake does not represent or warrant that substituted prizes are equivalent in nature or form.
6. Delivery of Prizes and Risk
6.1 Monetary Prizes will be sent directly to the winner’s Stake account (“Account”). It is your sole responsibility to nominate the correct Account. Stake accepts no liability for any error or delay caused by incorrect details.
6.2 The awarding of non-monetary Prizes may require additional information from you, including postal address or verification details. Failure to provide required information within the timeframe specified by Stake may result in forfeiture of the Prize.
6.3 Unless otherwise stated in the Competition Post, Stake will endeavour to distribute monetary Prizes and ship non-monetary Prizes within fourteen (14) days of winner verification.
6.4 Risk of loss or damage to non-monetary Prizes passes to the winner upon delivery of the Prize to the carrier. To the maximum extent permitted by law, Stake is not responsible for any loss, theft, damage, delay, or failure of delivery caused by third-party carriers or events beyond Stake’s reasonable control and is not obliged to replace lost or damaged Prizes.
6.5 To the extent permitted by law, Stake makes no representations or warranties regarding third-party supplied Prizes and is not responsible for manufacturer warranties, defects, or fitness for purpose.
7. Contacting Winners and Forfeiture
7.1 Winners may be contacted using any method determined by Stake, including social media messages, public announcements, email, or other contact details linked to the Account.
7.2 If a winner cannot be contacted, does not respond, fails verification, or fails to provide required information within the timeframe specified in the Competition Post (or within seventy-two (72) hours if no timeframe is specified), the Prize may be forfeited and reallocated at Stake’s absolute discretion.
7.3 No correspondence will be entered into regarding the outcome of any Competition.
8. Taxes
8.1 Winners are solely responsible for all taxes, duties, levies, customs charges, or fees arising from receipt of a Prize.
9. Eligibility
9.1 Eligibility criteria may vary between Competitions and will be specified in the relevant Competition Post.
9.2 Unless otherwise stated in the Competition Post, you must:
a. have an Account on the Website;
b. hold a minimum VIP level of “Bronze VIP”;
c. have completed KYC Level 2 verification;
d. not be subject to exclusions or restrictions;
e. not be an employee, agent, representative, or subcontractor of Stake (forum moderators are not excluded);
f. comply with the Terms and Conditions, including holding only one Account;
g. not be located in a Prohibited Jurisdiction; and
h. be at least 18 years of age, or the age of majority in your jurisdiction (whichever is higher).
9.3 Entrants under the age of majority are not eligible under any circumstances, including where parental or guardian consent is provided.
9.4 Stake reserves the right to withhold, cancel, or reclaim any Prize after award if the winner is later found to be ineligible or in breach of these Rules, the Terms and Conditions, or the Stake Community Terms of Use.
10. Entry Requirements and Social Media (If Applicable)
10.1 Entry requirements vary by Competition and apply only where specified in the Competition Post.
10.2 A Competition may provide for automatic entry without further action, as specified in the Competition Post.
10.3 Entry requirements may include following official Stake social media accounts, commenting on posts, referring friends, entering promotional codes, or completing other actions specified by Stake.
10.4 All qualifying actions must remain active and verifiable until the Prize is awarded. Failure to comply may result in disqualification. Completion of any entry requirement does not guarantee inclusion in a draw or selection of winners.
11. Competitions Involving Personal Posts or Real-World Activity (If Applicable)
11.1 Where a Competition requires or permits participants to create content or engage in real-world activities, participation is voluntary and undertaken at your own risk.
11.2 You must comply with these Rules, the relevant Competition Post, and any directions issued by Stake during the Competition.
11.3 You must not engage in conduct that is dangerous, misleading, sexually explicit, offensive, unlawful, inappropriate, or that depicts unsafe or sensitive locations, or otherwise brings Stake into disrepute.
11.4 You assume all risks associated with participation, including injury, harm, loss, or damage to person or property.
11.5 To the maximum extent permitted by law, you waive and release Stake and its affiliates from all liability arising from such participation.
11.6 Stake does not assume any duty to supervise, monitor, or ensure participant safety related to or arising from a Competition.
12. Experience, Event, or “Mystery” Prizes (If Applicable)
12.1 Experience, event or mystery-based Prizes (“Experience Prize”) are subject to availability and may vary by location, law, feasibility, and third-party requirements.
12.2 Stake may amend, substitute, or withdraw an Experience Prize where delivery is not legally or practically possible.
12.3 Winners may be required to provide additional documentation in order to claim any such Experience Prize, including proof of age or location.
12.4 Unless expressly stated otherwise, Stake is not responsible for incidental or ancillary costs to an Experience Prize, including travel, accommodation, insurance, medical expenses, or third-party disruptions.
12.5 Participation in Experience Prizes is at the winner’s own risk.
13. Technical Issues and Loss of Chance
13.1 Stake is not responsible for lost, incomplete, corrupted, delayed, misdirected, or failed entries, notifications, or participation caused by technical, network, platform, or system issues beyond its reasonable control.
13.2 Participation does not guarantee inclusion in any draw or winner selection.
13.3 To the maximum extent permitted by law, Stake excludes liability for any loss of chance or opportunity to win and has no obligation to rerun any Competition or redraw winners due to technical issues or errors.
14. Account Responsibility and Security
14.1 Stake may presume that all actions taken via an Account are performed by the Account holder.
14.2 Stake is not responsible for unauthorised access to or use of an Account.
14.3 You are solely responsible for maintaining the security of your Account and credentials.
15. Conduct, Reputation, and Fair Play
15.1 Stake may, at its absolute discretion, disqualify any entrant whose conduct is unlawful, misleading, offensive, abusive, or otherwise brings Stake or a Competition into disrepute.
15.2 Stake may, at its absolute discretion, disqualify entrants suspected of collusion, coordinated participation, third-party assistance, or any conduct intended to gain an unfair advantage.
16. Timing, Timezones, and Communications
16.1 All Competition times and deadlines are indicative only and subject to change at Stake’s discretion.
16.2 Stake’s determination of start times, end times, eligibility windows, and applicable timezones is final and binding.
16.3 Stake is not responsible for any misunderstandings arising from timezone differences.
17. Expectations and No Guarantee
17.1 Stake makes no representations or guarantees regarding any likelihood of winning.
17.2 Participation does not create any expectation, entitlement, or assurance of receiving a Prize.
18. Creator, Influencer, and Third-Party Independence
18.1 Where a Competition involves creators, influencers, streamers, or other third parties, their statements or conduct are promotional only.
18.2 Any conduct or statements made by creators, influencers, streamers, or other third parties in relation to a Competition do not amend or bind Stake unless expressly stated in writing by Stake.
19. Stake Rights and Discretion
19.1 Stake reserves the right, at its absolute discretion, to:
a. amend these Rules;
b. cancel or modify any Competition;
c. impose additional eligibility or entry requirements via a Competition Post;
d. verify Accounts and Prize redemption; and
e. take any action necessary to protect the integrity and fairness of a Competition.
19.2 All decisions made by Stake are final and binding.
19.3 Stake may refuse to award or may withhold a Prize where required by applicable law, regulation, sanctions requirements, or internal compliance obligations, without liability.
19.4 Stake reserves the right to verify that any Account, entry, or contact details used in connection with a Competition belong to the winner personally.
19.5 Stake is not liable for any failure or delay caused by events beyond its reasonable control.
20. Privacy
20.1 Personal information collected in connection with a Competition will be handled in accordance with Stake’s Privacy Policy and may be shared with third parties for administering the Competition and fulfilling Prizes.
21. Severability
21.1 If any provision of these Rules is held invalid or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.
22. General
22.1 Competitions are void where prohibited by law.
22.2 These Rules and all Competitions are governed by the laws applicable to the Stake Terms and Conditions.
